Where the Town Can and Cannot Work
Understanding Rights-of-Way, Easements, and Private Property
The Town is committed to maintaining public infrastructure—but we can’t work everywhere. This guide explains where we’re allowed to work, and where private property limits our role.
📍 Public Right-of-Way (ROW)
(Typically includes roads, sidewalks, and areas just beyond the curb)
What the Town Can Do:
- Maintain and repair streets and sidewalks
- Install and service utilities (water, sewer, gas, etc.)
- Trim or remove hazardous trees
- Clear stormwater drains and snow
What the Town Cannot Do:
- Alter landscaping installed by property owners without cause
- Enter private driveways or yards without permission
📘 Tip: If you’re not sure where your property ends, check your plat map or contact Town Hall.
🛠️Easements
(Specific areas on private property where the Town or utilities are allowed access)
What the Town Can Do:
- Access drainage systems, pipes, or utility lines
- Maintain ditches or stormwater channels
- Clear vegetation or blockages affecting drainage
What the Town Cannot Do:
- Use the easement for unrelated purposes
- Work outside the recorded easement boundary
- Maintain private structures (sheds, fences, etc.) even if they’re in an easement

🏡 Private Property
(Land owned by residents or businesses)
What the Town Can Do:
- Respond to emergencies or safety issues
- Enforce building and code violations (with notice)
- Access property with owner permission for specific projects
What the Town Cannot Do:
- Perform general maintenance or yard work
- Fix drainage issues entirely within private property
- Repair private driveways, fences, or sewer laterals
